Bank sentral Singapura telah menetapkan batas waktu 30 Juni bagi penyedia layanan kripto lokal untuk berhenti menawarkan layanan token digital (DT) ke pasar luar negeri. Arahan tersebut berasal dari tanggapan Otoritas Moneter Singapura (MAS) terhadap umpan balik industri mengenai kerangka regulasi yang diusulkan untuk Penyedia Layanan Token Digital (DSTP) berdasarkan Undang-Undang Layanan dan Pasar Keuangan tahun 2022 (Undang-Undang FSM).
MAS menyatakan bahwa tidak ada pengaturan transisi yang akan dibuat untuk DTSP lokal yang menyediakan layanan di luar negeri. Dikatakan bahwa setiap perusahaan, individu, atau kemitraan yang didirikan di Singapura yang menyediakan layanan DT di luar Singapura harus menghentikan operasi atau memperoleh lisensi saat ketentuan DTSP mulai berlaku pada akhir Juni.
“DTSP yang tunduk pada persyaratan perizinan berdasarkan pasal 137 Undang-Undang FSM harus menangguhkan atau menghentikan menjalankan bisnis penyediaan layanan DT di luar Singapura paling lambat 30 Juni 2025,” tulis MAS. Berdasarkan Pasal 137 Undang-Undang FSM, bisnis yang berbasis di Singapura dianggap beroperasi dari Singapura dan karenanya tunduk pada perizinan. Ini termasuk perusahaan yang aktivitas terkait token di luar negerinya bukan merupakan aktivitas bisnis utama mereka.
Perusahaan yang kedapatan melanggar undang-undang akan dikenakan denda besar hingga 250.000 dolar Singapura ($200.000) dan hukuman penjara hingga tiga tahun.
MAS mengatakan hanya perusahaan yang memiliki izin atau dikecualikan berdasarkan undang-undang keuangan yang berlaku, yaitu Undang-Undang Sekuritas dan Berjangka, Undang-Undang Penasihat Keuangan, atau Undang-Undang Layanan Pembayaran yang boleh terus beroperasi tanpa bertentangan dengan aturan baru.
Langkah tersebut menandakan pengetatan besar pengawasan regulasi terhadap aktivitas kripto oleh otoritas Singapura. Mandat bagi DTSP untuk menghentikan aktivitas di luar negeri berasal dari perkembangan regulasi yang ditujukan untuk mengatasi risiko di sektor aset digital.
Pada bulan April 2022, Singapura mengesahkan RUU FSM, yang memberikan MAS kewenangan lebih besar untuk mengatur perusahaan kripto yang beroperasi di luar negeri tetapi berpusat di Singapura.
Undang-undang tersebut mengharuskan DTSP dengan operasi di luar negeri untuk mematuhi standar AML dan CFT meskipun mereka tidak menawarkan layanan di Singapura. MAS menyatakan kekhawatiran bahwa perusahaan kripto dapat mengeksploitasi celah regulasi dengan mendaftar di Singapura sambil melakukan aktivitas yang tidak diatur di luar negeri.
